This Privacy Policy (“Policy”) is designed to help you to understand what kind of information we collect in connection with our products and services and how we process and use such information. Throughout this Policy the term “personal data” means information relating to an identified or identifiable individual (i.e. a natural person). You acknowledge and agree that your personal data collected may be used in accordance with this Policy and applies to personal data collected in connection with products and services offered by 2859910 Ontario Inc. 2859910 Ontario Inc. may from time to time update and change this Privacy Policy. Any changes we may make to our privacy policy in the future will be posted on this page and, where appropriate, notified to you by email and/or when you next start the App or use the Site. The new terms may be displayed on-screen and you may be required to read and accept them to continue your use of the App or the Services.
Information collected
We collect information about you and your device. We collect information you give us, and we collect information automatically. Information you submit to us by filling in forms on the App and/or the Site, signing up for our newsletter or by corresponding with us (for example, by e-mail or via the chat functions on the App and/or the Site). It includes information you provide when you register to use the App, download or register the App, subscribe to any of our services, enter into any transaction on the App or the Site, participate in discussion boards or other social media functions on the App or the Site and when you report a problem with an App, the Services, or the Site. If you contact us, we will keep a record of that correspondence. The information you give us may include your name, address, date of birth, e-mail address, phone number, the Device’s phone number, username, password and other registration information. Each time you visit the App or our Site we will automatically collect information like internet protocol (IP) address used to connect your computer to the Internet, browser type and version, information and the type of mobile device you use, mobile network information, your mobile operating system, the type of mobile browser you use. Browsing behavior, such as the date and time you visit the Sites, the areas or pages of the Sites that you visit, the number of times you return to the Sites, page response times, download errors, length of visits to certain pages, page interaction information, methods used to browse away from the page, device information. We are not looking to collect any information from persons under the legal age in their respective country. Our databases may contain personal data of children since it is not always possible to determine precisely the age of the user. We reserve the right to block the service from any person who is or whom we reasonably suspect of being a minor. Additionally, we may collect location data during the logging of a vehicle that is in motion. This location data includes real-time geographic location information, which can help us understand vehicle performance and behavior in different environmental conditions. You can disable location data collection through your device’s settings, but this may limit the functionality of certain features of the App.
Information disclosure
We may use collected information to deliver our services to you, to contact you with site updates, newsletters, marketing materials from us and our business partners marketing offers. We work closely with third parties in order to help us deliver our service to you. We may share information collected with third parties service providers, our marketing partners, payment and delivery services, cloud storage providers advertising networks, analytics providers, search information providers, customer service providers and developers, provide information to law enforcement agencies as required by law. The Sites may contain links to third-party websites, social media sites, which may have privacy policies different than ours. We are not responsible for the activities and practices that take place on these websites. Unfortunately, the transmission of information via the internet is not completely secure. Although we will do our best to protect your personal data, we cannot guarantee the security of your data transmitted to our App or our Site; any transmission is at your own risk. Once we have received your information, we will use strict procedures and security features to try to prevent unauthorised access. Certain Services include social networking, chat room or forum features. Ensure when using these features that you do not submit any personal data that you do not want to be seen, collected or used by other users. Personal information that we collect, access or process will be retained only if necessary, to provide you with our services and information, or as required by law. Personal information that is no longer required will be erased.
Disclaimer of warranties and limitation of liability
Neither we nor any third parties provide any warranty or guarantee as to the accuracy of the information and materials found or offered within this app. We exclude liability for any such inaccuracies or errors. Use of any information or products within this app is at your own risk, for which we shall not be liable. 2859910 Ontario Inc. disclaims any warranties with regards to this application and your purchase of any products here under. You expressly acknowledge and agree that use of the licensed application, the materials and services in the application are provided “As Is” and ”As Available”,2859910 Ontario Inc. will not guaranty or make any representations regarding the use of, or the result of the use of, the material in the application in terms of their, accuracy, reliability. It is your own responsibility to ensure that any products, services or information available through this app meet your specific requirements. We are not responsible for the contents of any links provided to third party web sites. You acknowledge that such information and materials may contain inaccuracies or errors or that the application or the server that makes it available are free of viruses.
Products offered within D Flasher are for use only in competition closed course driving and may not be legal for “on highway use”. 2859910 Ontario Inc. does not guarantee legality of any software used on street driven vehicles. It is customer responsibility to check local laws before purchasing and installing a product. We are not responsible for any fees and fines received by customer due to failing to check compliance with local law before purchasing and installing a product. Some items used and/or installed by D Flasher may void portions of your vehicle’s factory warranty and 2859910 Ontario Inc. will not be held liable. Damages caused by modifications, improper installations or improper use are not our responsibility. We are not responsible for a repair costs, liabilities and damages occurred. Performance software modification may involve risks like performance loss, engine failure, transmission failure, fire, personal injuries (including all people travelling in the customer vehicle) 2859910 Ontario Inc. is not responsible for those risks. By submitting activation customer acknowledge he read and understands this document and agree to be bound by its terms and would like to proceed with modifications.
User rights
You have the right to request information and access to the personal data we have collected from and of you. You also have the right to request that we anonymize or delete any incomplete, incorrect, unnecessary or outdated personal data we hold on you. However, we cannot delete personal data that is necessary to comply with local law. Where your personal data is processed based on your consent for direct marketing purposes, sending promotional materials, profiling, or for the performance of market research, you have the right to withdraw your consent for such processing at any time by contacting us through the contact points referred in the marketing materials or below in this Policy. In some cases, especially if you wish us to delete or cease the processing of your personal data, this may also mean that we may not be able to continue to provide the services to you. We may need to request specific information from you to help us confirm your identity and ensure your right to access your personal data (or to exercise any of your other rights). D-FLASHER PRE-FLASHING DISCLAIMER AND TERMS OF USE
IMPORTANT: READ CAREFULLY BEFORE USING THIS APPLICATION
By proceeding with the use of D-Flasher (the “Software”), you (the “User”) acknowledge and agree to the terms and conditions set forth in this Pre-Flashing Disclaimer and Terms of Use Agreement. If you do not agree to these terms, do not proceed with the software installation, tuning, or flashing process.
1. OFF-ROAD AND COMPETITION USE ONLY

D-Flasher is strictly intended for use in closed-course racing, competition, or off-road purposes only.

By using this software, you confirm that you are in compliance with all applicable local, state, provincial, and federal laws.
2. WARRANTY AND DAMAGE

Any tuning or modifications performed using D-Flasher may void manufacturer warranties and service agreements.

The User assumes full responsibility for any damage, malfunction, or failure, including but not limited to engine damage, drivetrain damage, or electronic control unit (ECU) failure.

The Providers shall not be held liable for any damages or expenses resulting from the use of this software.
3. USER RESPONSIBILITY

The User acknowledges they possess the necessary mechanical and technical knowledge to operate and apply tuning software safely and responsibly.

The User agrees to conduct adequate research and consultation prior to using D-Flasher.
4. NO LIABILITY AND INDEMNIFICATION

The Providers disclaim all liability for any claims, damages, or losses arising from the use of D-Flasher.

The User agrees to indemnify, defend, and hold harmless the Providers against any claims, legal actions, or demands, including attorneys’ fees, resulting from misuse, negligence, or non-compliance.
5. ASSUMPTION OF RISK

By proceeding, the User voluntarily assumes all risks associated with ECU tuning, including but not limited to mechanical failure, legal penalties, and personal injury.

The User understands that flashing the ECU or other modules can lead to unintended consequences that may compromise performance and safety.
6. AGREEMENT TO TERMS
By selecting "I Agree" or otherwise proceeding with the use of D-Flasher, you confirm that you:
