D-FLASHER DISCLAIMER AND TERMS OF USE AGREEMENT

IMPORTANT: READ CAREFULLY BEFORE USING THIS APPLICATION 

This policy applies to the use of websites https://www.dflasher.com, use of our social media sites (the “Sites”), D Flasher (“App”) once you have downloaded a copy of the App onto your mobile telephone or handheld device (“Device”) and any of the services accessible through the App or the Site, email, phone call (the “Services”). 

By proceeding with the use of D-Flasher (the “Software”), you (the “User”) acknowledge and agree to the terms and conditions set forth in this Disclaimer and Terms of Use Agreement. We 2859910 Ontario Inc (the “Company”) do not intend to use our products for any illegal purpose whatsoever. By purchasing any of our product(s) you acknowledge and approve the following:

You agree that the product(s) will be used exclusively in a lawful manner. If you're in doubt as to the legality of your planned usage you should consult with a lawyer and obtain independent legal advice. You acknowledge that you are solely responsible for complying with all relevant laws in your area and the area(s) where our product(s) are being used.

You fully understand and affirm that D Flasher is sold without warranty, some products sold are not designed for sale or use on street compliant vehicles, pollution-controlled machines (or vehicles). Products are intended for closed- course off- road competition only in accordance with the Clean Air Act and may never be used on a public road or highway, unless permitted by specific regulatory exemptions. You take full responsibility for the use and/or misuse of this product in accordance with the clean air act. You agree that the Company holds no responsibility for any consequences, legal, or other, of such use or misuse.

By clicking below, you are certifying to us that the parts (including software) or equipment you are buying today will only be used for lawful purposes and will not be used to defeat OEM emissions control equipment or emissions performance in violation of the U.S. Clean Air Act, or the laws of your area. You confirm that you are in compliance with all applicable local, state, provincial, and federal laws.

Disclaimer of warranties, damages and limitation of liability 

Neither we nor any third parties provide any warranty or guarantee as to the accuracy of the information and materials found or offered within this app. We exclude liability for any such inaccuracies or errors. Use of any information or products within this app is at your own risk, for which we shall not be liable. Company disclaims any warranties with regards to this application and your purchase of any products here under. You expressly acknowledge and agree that use of the licensed application, the materials and services in the application are provided “As Is” and” As Available”, Company will not guaranty or make any representations regarding the use of, or the result of the use of, the material in the application in terms of their, accuracy, reliability. It is your own responsibility to ensure that any products, services or information available through this app meet your specific requirements. We are not responsible for the contents of any links provided to third party web sites. You acknowledge that such information and materials may contain inaccuracies or errors or that the application or the server that makes it available are free of viruses. 

Under no circumstance, including, but not limited to, negligence, shall the Company be liable for any direct, indirect, incidental, consequential or any other damages whatsoever, whether in action or under contract or otherwise, damages that result from the use of, or inability to use, the information, materials or products contained in or purchased. The Company shall have no liability or responsibility for any delay in the delivery, installation or use of the products, as well as the service life of the products, performance, applicability for the use intended, proper installation, or the accuracy of information provided, or damage caused by our products. The use of the product modifications and installations are at the customer’s own risk. The Company does not guarantee the legality of any software used on street-driven vehicles. It is the customer’s responsibility to verify compliance with local laws before purchasing and installing a product. We are not responsible for any fees and fines received by customer due to failing to check compliance with local law before purchasing and installing a product. It is the responsibility of the installer and/or end user of the product to ensure that it is used in compliance with all applicable laws and regulations. Users should act in accordance with their local laws and regulations. Company takes no responsibility for compliance with the vehicle’s manufacturer warranty and service agreement. Some items used and/or installed by D Flasher may void portions of your vehicle’s factory warranty and Company will not be held liable. All modifications and installations are at the customer and/or end user’s own risk and take full responsibility for any use or misuse of the product and agrees that the Company holds no responsibility for any consequences, legal, or other, of such use or misuse. Some products may require additional modifications and additional maintenance. Individual results may vary depending on vehicle setup, quality of installation, environmental conditions, overall vehicle health, testing equipment and more. We are not responsible for improper installation and use of products. Damages caused by modifications, improper installations or improper use are not our responsibility. We are not responsible for a repair costs; liabilities and damages occurred. Modification may involve risks like performance loss, engine failure, transmission failure, fire, personal injuries (including all people travelling in the customer vehicle) Company is not responsible for those risks. By submitting activation customer acknowledge he read and understands this document and agree to be bound by its terms and would like to proceed with modifications. 

Currency

All prices and transactions on this website are listed and processed in United States Dollars (USD), unless otherwise stated. While we operate in Canada, we use USD as our standard currency for consistency and ease of international transactions. Please be aware that exchange rates may vary, and your financial institution may charge additional fees for currency conversion. We are not responsible for any discrepancies or additional charges related to exchange rates or foreign transaction fees.

Returns and Refunds Conditions

Returns of not used License can be made 14 days from date of purchase. No returns on shipped adapters. No refunds on shipping and/or duties costs. Restocking fee of 20% applies to all returns. No returns on discounted orders. To start a refund please email us along with the order number. Please send only one return ticket to avoid delays. Refunds will be issued upon acceptance. Bank processing times and fees may affect refund amount.

Any of the services accessible through the App or the Site, email, phone call (the “Services”) By accessing those Sites and Services you agree that you have read and consent to be bound to the Privacy Policy. Company is committed to protecting your privacy and complying with applicable data protection and privacy laws. This Privacy Policy (“Policy”) is designed to help you to understand what kind of information we collect in connection with our products and services and how we process and use such information. Throughout this Policy the term “personal data” means information relating to an identified or identifiable individual (i.e. a natural person). You acknowledge and agree that your personal data collected may be used in accordance with this Policy and applies to personal data collected in connection with products and services offered by a Company may from time-to-time update and change this Privacy Policy. Any changes we may make to our privacy policy in the future will be posted on this page and, where appropriate, notified to you by email and/or when you next start the App or use the Site. The new terms may be displayed on-screen, and you may be required to read and accept them to continue your use of the App or the Services. 

Information collection and use

We collect information about you and your device. We collect information you give us, and we collect information automatically. Information you submit to us by filling in forms on the App and/or the Site, signing up for our newsletter or by corresponding with us (for example, by e-mail or via the chat functions on the App and/or the Site). It includes information you provide when you register to use the App, download or register the App, subscribe to any of our services, enter into any transaction on the App or the Site, participate in discussion boards or other social media functions on the App or the Site and when you report a problem with an App, the Services, or the Site. If you contact us, we will keep a record of that correspondence. The information you give us may include your name, address, date of birth, e-mail address, phone number, the Device’s phone number, username, password and other registration information. Each time you visit the App or our Site we will automatically collect information like internet protocol (IP) address used to connect your computer to the Internet, browser type and version, information and the type of mobile device you use, mobile network information, your mobile operating system, the type of mobile browser you use. Browsing behavior, such as the date and time you visit the Sites, the areas or pages of the Sites that you visit, the number of times you return to the Sites, page response times, download errors, length of visits to certain pages, page interaction information, methods used to browse away from the page, device information. We are not looking to collect any information from persons under the legal age in their respective country. Our databases may contain personal data of children since it is not always possible to determine precisely the age of the user. We reserve the right to block the service from any person who is or whom we reasonably suspect of being a minor. Additionally, we may collect location data during the logging of a vehicle that is in motion. This location data includes real-time geographic location information, which can help us understand vehicle performance and behavior in different environmental conditions. You can disable location data collection through your device’s settings, but this may limit the functionality of certain features of the App. 

Our website uses cookies and similar tracking technologies to enhance your browsing experience, analyze website traffic, and personalize content. Cookies are small data files stored on your device that help us remember your preferences and understand how you interact with our site. We may use collected information to deliver our services to you, to contact you with site updates, newsletters, marketing materials from us and our business partners marketing offers. We work closely with third parties to help us deliver our service to you. We may share information collected with third parties service providers, our marketing partners, payment and delivery services, cloud storage providers advertising networks, analytics providers, search information providers, customer service providers and developers, provide information to law enforcement agencies as required by law. The Sites may contain links to third-party websites, social media sites, which may have privacy policies different than ours. We are not responsible for the activities and practices that take place on these websites. Accordingly, we recommend that you review the privacy policy posted on any external site before disclosing any personal information. Please contact those websites directly if you have any questions about their privacy policies. Please note that if you submit any personal information, the information becomes publicly available and can be collected and used by others, so you should use care before posting information about yourself online. We keep the personal data we collect secure and implement appropriate security measures. All information you provide to us is stored on our secure servers. Unfortunately, the transmission of information via the internet is not completely secure. Although we will do our best to protect your personal data, we cannot guarantee the security of your data transmitted to our App or our Site; any transmission is at your own risk. Once we have received your information, we will use strict procedures and security features to try to prevent unauthorised access. Certain Services include social networking, chat room or forum features. Ensure when using these features that you do not submit any personal data that you do not want to be seen, collected or used by other users. Personal information that we collect, access or process will be retained only, if necessary, to provide you with our services and information, or as required by law. Personal information that is no longer required will be erased. 

User rights 

You have the right to request information and access to the personal data we have collected from and of you. You also have the right to request that we anonymize or delete any incomplete, incorrect, unnecessary or outdated personal data we hold on to you. However, we cannot delete personal data that is necessary to comply with local law. Where your personal data is processed based on your consent for direct marketing purposes, sending promotional materials, profiling, or for the performance of market research, you have the right to withdraw your consent for such processing at any time by contacting us through the contact points referred in the marketing materials or below in this Policy. In some cases, especially if you wish us to delete or cease the processing of your personal data, this may also mean that we may not be able to continue to provide the services to you. We may need to request specific information from you to help us confirm your identity and ensure your right to access your personal data (or to exercise any of your other rights). This is a security measure to ensure that personal data is not disclosed to any person who has no right to receive it. 

Complaint to the supervisory authority 

In the event you consider Company processing activities of your personal data to be inconsistent with the applicable data protection laws or that not sufficiently ensured the realisation of your rights, you may lodge a complaint with the local supervisory authority responsible for data protection matters.
